Welcome to Viva La Burma. By accessing or using our website, or by purchasing products from us, you agree to be bound by these Terms of Service (ToS). Please read them carefully.

Viva La Burma is a social enterprise committed to providing ethically-produced artwear and supporting the Burmese creative community. Our policies reflect our mission and our made-to-order production model.

1. General Conditions and Use of Service

1.1. Acceptance of Terms: These ToS constitute a legally binding agreement between you and Viva La Burma. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

1.2. Changes to Terms: We reserve the right to update, change, or replace any part of these ToS by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes.

1.3. Intellectual Property: All designs, art, text, graphics, and content on this website are the property of Viva La Burma or our featured Burmese artists and are protected by copyright laws. You may not use any content, including the unique artwork, without our express written permission.

2. Orders and Product Policy

2.1. Made-to-Order Nature: All products sold by Viva La Burma are made-to-order. This means we begin production only after your order is placed and confirmed.

2.2. Product Accuracy: We make every effort to display the colors and images of our products as accurately as possible. We cannot guarantee that your device’s display of any color will be accurate. Minor variations in print placement or color saturation may occur due to the custom production process and are not considered flaws.

2.3. Pricing: All prices are subject to change without notice. We reserve the right to refuse any order you place with us.

3. Payment Policy (Domestic Thailand Only)

3.1. Payment Gateway: We utilize Pay Solutions as our secure payment gateway.

3.2. Accepted Payment Methods: We accept a wide range of payment options for domestic orders in Thailand, including:

  • Credit/Debit Cards: Visa, Mastercard, JCB, and UnionPay.

  • Mobile & QR Payments: PromptPay and TrueMoney Wallet.

  • Bank Transfers: Direct payment via major Thai bank applications.

  • Installment Plans: Available for qualified cards from major Thai banks.

3.3. Payment Confirmation: Orders are not confirmed and production will not begin until full payment is successfully received through the payment gateway.

4. Shipping and Delivery Policy (Domestic Thailand Only)

4.1. Shipping Carrier: All orders are shipped via Flash Delivery (Flash Express) within Thailand.

4.2. Shipping Scope: We only deliver to addresses within Thailand. We currently do not offer international shipping.

4.3. Delivery Timeline: The total estimated time to receive your order includes:

  • Production Time: 3–5 business days.

  • Delivery Time (Flash Express): 1–3 business days, depending on location.

4.4. Order Tracking: Once shipped, you will receive a tracking number via email to follow your package’s progress on the Flash Express website or mobile application.

5. Returns and Exchange Policy (Serious Flaws Only)

5.1. General Rule (All Sales Final): Due to the custom, made-to-order nature of our products and our commitment to sustainable ethical production, all sales are considered final. We do not offer returns, refunds, or exchanges for change of mind, incorrect size selection by the customer, or minor print variations.

5.2. Eligible Exceptions: We will offer a replacement or refund only for the following exception-based issues:

  • Serious Manufacturing Flaw: A major defect that renders the item unwearable (e.g., irreparable tears, non-functioning zipper, significant stitching error).

  • Fulfillment Error: You received an item clearly different from what you ordered (e.g., wrong design or wrong size tag than ordered).

  • Shipping Damage: The product was severely damaged in transit and is unwearable upon arrival.

5.3. Exception Request Process:

  • You must notify us within 7 days of the delivery date.

  • The item must be unused, unwashed, and in its original packaging with tags.

  • You must provide clear photographic evidence of the defect or error in your email to Customer Service.

  • Do not send the item back until you receive explicit authorization and a prepaid shipping label from us.

6. Limitation of Liability

Viva La Burma shall not be liable for any special, incidental, punitive, or consequential damages related to the use of our products. While we strive for timely delivery, we are not responsible for delays caused by the courier (Flash Express), customs, or other external forces. Our liability is strictly limited to the purchase price of the product you purchased.
